EXECUTIVE SUMMARY

 

  1. This Privacy Policy is an electronic record in the form of an electronic contract formed under the Information Technology Act, 2000, and the rules and regulations made thereunder, and does not require any physical, electronic, or digital signature.
  2. The myValU application, Val-U Communication Centre, isic.com and website isic.co.in (together: the "Application" or "app") are operated by STIC Youth Travels Pvt. Ltd. (hereinafter referred to as "ISIC", and "we", "our", "us") in India.
  3. For the purpose of this Privacy Policy, wherever the context so requires "you" or "your", it shall mean "User" and the term "Website" means the website(s), mobile site(s) and mobile app(s).
  4. We are committed to protecting and respecting your privacy in accordance with the applicable privacy legislation in India. This Privacy Policy sets out how we collect, use and share information that identifies you or is associated with you ("Personal Information").
  5. This Privacy Policy provides for the practices for the collection, use, handling, disclosure, storage, and transfer of the user's Personal Information by ISIC and its subsidiaries and affiliates.
  6. This Privacy Policy is applicable to any person ("User") who purchases, intends to purchase, or enquires about any product(s) or service(s) made available by ISIC through any of ISIC’s customer interface channels including its website, myValU app & offline channels including call centres and offices (collectively referred herein as "Sales Channels").
  7. This Privacy Policy is a legally binding document between the you and ISIC. The terms of this Privacy Policy will be effective upon your registration on the Application and/or the Website and will govern the relationship between you and ISIC for your use of the Application and/or the Website.
  8. Please read this Privacy Policy carefully. By using or accessing the Website or other Sales Channels, the User hereby agrees with the terms of this Privacy Policy and the contents herein.
  9. By providing us your Personal Information, or by making use of the Services (hereinafter defined) provided by Application and/or Website, you hereby consent to the collection, use, handling, disclosure, storage, and transfer of any or all of your Personal Information by ISIC, as specified under this Privacy Policy.
  10. If you disagree with this Privacy Policy please do not use or access our Application, Website, or any other of our Sales Channels.
  11. This Privacy Policy does not apply to any website(s), mobile sites and mobile apps of third parties, even if their websites or products are linked to our Website. The User should take note that information and privacy practices of ISIC’s business partners, advertisers, sponsors or other sites to which ISIC provides hyperlink(s), may be materially different from this Privacy Policy. Accordingly, it is recommended that you review the privacy statements and policies of any such third parties with whom they interact.
  12. This Privacy Policy is an integral part of your User Agreement with ISIC & STIC Youth Travels Pvt. Ltd. and all capitalised terms used, but not otherwise defined herein, shall have the respective meanings as ascribed to them in the User Agreement.
  13. You should also be aware that we use cookies to store and access information whilst providing access to our Application. You can find out more about our use of cookies in Article 6 herein. We are responsible for providing this Application and for the processing of your Personal Information in relation to this.

  1. PERSONAL INFORMATION WE HOLD ABOUT YOU
    1. We collect Personal Information from you when you voluntarily submit information directly to us or our Application. This can include information you provide when you register to use the Application, login to the Application, complete a form, correspond with us, use discounts via our Application, or subscribe to our email lists.
    2. We also collect Personal Information indirectly from you, such as information about the pages you look at on the Application and the device you connect to the Application with.
    3. We may also collect Personal Information about you from third parties such as our partners. This may be combined with other information you provide to us, as described above. Each Partner is responsible for providing notice to its cardholders concerning the purpose for which it collects Personal Information and how this Personal Information is processed.
    4. Transactional history (other than banking details) about your e-commerce activities, buying behaviour.
    5. Your usernames, passwords, email addresses and other security-related information used by you in relation to our Services.
    6. Data either created by you or by a third party and which you wish to store on our servers such as image files, documents etc.
    7. Data available in public domain or received from any third party including social media channels, including but not limited to personal or non-personal information from your linked social media channels (like name, email address, friend list, profile pictures or any other information that is permitted to be received as per your account settings) as a part of your account information.
    8. The copies of your passport, identity proof, student status proof.
    9. Surveys: We value opinions and comments from our Users and frequently conduct surveys, both online and offline. Participation in these surveys is entirely optional. Typically, the information received is aggregated, and used to make improvements to Website, other Sales Channels, services and to develop appealing content, features and promotions for members based on the results of the surveys. Identity of the survey participants is anonymous unless otherwise stated in the survey.

  1. Contact details: such as your name, your email address and your telephone number associated with your account.
  2. Account information: such as your contact details (as above) and other any information you share when creating an account with our Application, that may include, but is not limited to, date of birth, gender, or occupation.
  3. Your preferences: choices you make such as notification and messaging preferences or choices about how the Application is set up.
  4. Information about how you use and connect to the Application:
  1. We collect information about how you use the Application such as the pages and links you access, the discounts you have selected, the time you access the Application and duration you are on it, the website you come to the Application from or go to after leaving the Application and selections and choices you make when using the Application.

We also collect information about the computer or other electronic devices you use to connect to the Application such as details about the type of device (which can include unique device identifying numbers), its operating system, browser and other applications connected to the Application through the device, your Internet service provider, or mobile network, your IP address and your device's telephone number.
  3. We may also collect information that you have given permission to upload, synchronise or import (such as phone status or identity, contacts, calendar, camera, microphone, or short messaging system) during your use of the Application and/or Website.

  2. Information provided by other organisations: Other organisations may provide information that we associate with you, where they are lawfully permitted to share it, such as contact details, demographic data, or internet navigation information.

    1. We respect your privacy rights and provide you with reasonable access to the Personal Information that you have provided through your use of the Application. You can:
  1. update, correct, or delete your Account information and preferences at any time by accessing your Account/Profile settings page in the Application. Please note that while any changes you make will be reflected in active user databases instantly or within a reasonable period, we may retain all information you submit for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so.
  2. access or amend any Personal Information we hold about you, or request that we delete or transfer any information about you that we have obtained from third parties.
  3. decline to share certain Personal Information with us, in which case we may not be able to provide to you some or all features and functionality of the Application.

If you believe your right to privacy granted by applicable data protection laws has been infringed upon, please contact us using the contact details set out in the Article 13 herein. You also have the right to lodge a complaint with data protection authorities.

  1. HOW WE USE YOUR INFORMATION
    1. We will also use your Personal Information for the purposes specifically described below:
  1. Contact details: we will use your contact details so that we can communicate with you directly about our organisation discounts and about queries, issues or concerns you or other users have.
  2. Account information: we use your account information to provide our service to you and ensure that you are able to interact with the Application as permitted by the functionality of the Application and your preferences.
  3. Your preferences: we will use your preference settings for the purpose of providing notifications, messages, displaying the Application and following other choices you are able to make about how the Application is displayed to you.
  4. Information about discounts you have looked at: we use this information to send you reminders and to determine discounts that may be of interest to you.
  5. Information about how you use and connect to the Application: we use this information to present the Application to you on your device. We will also use this information to determine products and services that may be of interest to you.
  6. Information about your location: we may use your location or an approximation thereof to ensure the content and deals on the Application are relevant to the city, state or country you are using the Application in. We will not collect or track your exact location without your consent.
  7. We will use all the Personal Information we collect to:
  1. monitor and improve the Application and our procedures and processes; and
  2. to help us develop new products and services. Our use of your Personal Information in this way will not result in information that was not previously publicly available being made public on the Application.
    1. We may anonymise and aggregate any of the information we collect (so that it does not directly identify you). We may use anonymised information for purposes that include testing our IT systems, research, data analysis, improving the Application, developing new products and features or displaying information about the discounts used via our Application such as the most popular discounts or discounts based on an approximate location.
    2. SMS: If you allow us to access your SMS, we read your SMS to autofill or prepopulate ‘OTP’ while making a transaction and to validate your mobile number. This provides you a seamless purchase experience and you don’t need to move out of the app to read the SMS and then enter it in the app.
    3. Phone: The app requires access to make phone calls so that you can make phone calls to benefit and service providers and our customer contact centres directly through the app.
    4. Contacts: If you allow us to access your contacts, it enables us to provide a lot of social features to you such as inviting your friends to try our app, send across referral links to your friends, etc. We may also use this information to make recommendations. This information will be stored on our servers and synced from your phone.
    5. Photo/ Media/ Files: The libraries in the app use these permissions to allow map data to be saved to your phone's external storage, like SD cards. By saving map data locally, your phone doesn't need to re-download the same map data every time you use the app. This provides you a seamless map-based benefits selection experience, even on low bandwidth network.
    6. Wi-Fi connection information: When you allow us the permission to detect your Wi-Fi connection, we optimise your experience such as more detailing on maps, better image loading etc.
    7. Device ID & Call information: This permission is used to detect your ID through which we can uniquely identify users. It also lets us know your contact details using which we pre-populate specific fields to ensure a seamless experience.
  1. PERSONAL INFORMATION WE SHARE WITH THIRD PARTIES
    1. We may share your Personal Information with the following parties:
  1. Companies and organisations that are subsidiaries of our organisation and with the ISIC Association: these companies and this organisation will only use your Personal Information in the same way as we can under this Privacy Policy.
  2. Companies and organisations that are partners under contract with our organisation may receive aggregated statistics on the metrics and use of the deals.
  3. Service providers, partners, and advisors: third parties who provide a service to us, partner with us on marketing and other business activities, advise us or that we work with in other business capacities. For example, we use a third party for the hosting of the Application and your Personal Information. These third parties will only be allowed to use your Personal Information in accordance with our instructions or your marketing preferences (where applicable) and will be required to keep your information secure.
  4. Law enforcement, regulators, and other parties for legal reasons: third parties who we are under a legal obligation to disclose your Personal Information to or who we need to disclose your Personal Information to protect our rights, property or safety or the rights, property or safety of others, detection and investigation of illegal activities and breaches of any agreement we have with you.
    1. We may provide third parties with aggregate statistical information and analytics about users of the Application, but we will make sure no one can be identified from this information before we disclose it.
  1. MARKETING
    1. From time to time we may contact you by email with information about our organisation and our activities, products and services. If you do not want us to send you email marketing, you can unsubscribe from our emails by clicking on the unsubscribe link (where available) in the emails we send to you.
    2. We may send (push-)notifications directly to your device, for example to inform you about a nearby discount. If you do not want to get these notifications, you can generally disable this through the settings on your device and/or your preferences in the Application.
    3. ISIC may use third-party service providers to serve advertisements on behalf of ISIC across the internet and sometimes on the Website. They may collect information about your visits to the Website, and your interaction with our products and services on the Website.
    4. You may also be subscribed to local newsletters and similar messages provided by partners or ISIC members. Please refer to these parties directly if you wish to unsubscribe from such messages, as these messages are not sent by us.

    1. We may store information (which may include Personal Information) locally on your device using cookies and other browser and application storage methods. Cookies can be seen as text files, containing small amounts of information, which are downloaded to your browsing device (such as a computer or smartphone) when you visit a website or use an Application. Cookies can be recognised by the website that downloaded them — or other websites that use the same cookies. This helps websites know if the browsing device has visited them before.

    1. Your Personal Information will primarily be stored in electronic form. However, certain data may also be stored in physical form.
    2. We will take all reasonable steps to ensure that your Personal Information is treated securely and in accordance with this Privacy Policy.
    3.   3. SECURITY AND RETENTION OF PERSONAL INFORMATION
    1. The security of your Personal Information is important to us. ISIC strives to ensure the security of your Personal Information and to protect it against unauthorised access or unauthorised alteration, disclosure, or destruction. For this purpose, ISIC adopts internal reviews of the data collection, use, handling, disclosure, storage, and transfer practices.
    2. ISIC adopts reasonable security practices and procedures, including reviews of security measures, appropriate encryption, and physical security measures to guard against unauthorised access to systems where ISIC stores your Personal Information.
    3. If you choose a payment gateway to complete any transaction on the Website, then your credit or debit card data may be stored in compliance with industry standards and recommended data security standards for the security of financial information such as the Payment Card Industry Data Security Standard.
    4. You agree that all Personal Information shall be retained until such time as it is no longer required to be used, or until required under applicable law, whichever is later.
  4. REPRESENTATIONS AND WARRANTIES
    1. You hereby represent to ISIC that, at all times during your registration with us, that:
  1. the information you provide to ISIC is and shall be authentic, correct, current and updated, and that you have all the rights, permissions and consents as may be required to provide such information (including Information pertaining to any third parties) to ISIC; and,
  2. your providing the information to ISIC and the consequent collection, use, handling, disclosure, storage, and transfer of the same by ISIC shall not be in violation of any third-party agreement, laws, charter documents, judgments, orders, or decrees.
    1. The officers, directors, contractors or agents of ISIC shall not be responsible for the authenticity of the information that you or any other user provides to ISIC, its subsidiaries or affiliates.
    2. Indemnity: You shall indemnify and hold harmless ISIC, its officers, directors, contractors, or agents, and any third parties relying on the information provided by you for any losses, including all claims, damages, liabilities, deficiencies, assessments, interest, awards, settlements, penalties, fines, costs, or expenses suffered, incurred, sustained by, or imposed on ISIC, as a result of, arising out of, with respect to, in connection with, or by reason of a breach or non-performance by you of any of the terms, conditions, representations, or warranties contained in this Privacy Policy.
  1. LIABILITITY
    1. Your right to claim damages shall be limited to the right to claim only statutory damages under the Information Technology Act, 2000, and you hereby waive and release ISIC from any claim of damages under contract or tort, to the extent permissible under applicable laws.
    2. Notwithstanding anything contained in this Policy or elsewhere, to the extent permissible under applicable laws, ISIC shall not be held responsible for any loss, damage or misuse of your Personal Information, if such loss, damage or misuse is attributable to a "Force Majeure Event" in Clause 11.3 herein.
    3. A Force Majeure Event shall mean any event that is beyond the reasonable control of ISIC and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorised access to computer(s), computer system(s), or computer network(s), computer crash(es), breach(es) of security and encryption (provided it is beyond the reasonable control of ISIC), power or electricity failure, or unavailability of adequate power or electricity.
    4. While we will endeavour to take all reasonable and appropriate steps and precautions to keep secure any Personal Information which we hold about you and prevent unauthorised access, you acknowledge that the internet and computer networks are not fully secure and that we cannot provide an absolute assurance regarding the security of your Personal Information.

    1. We may update this Privacy Policy from time to time and so you should review this policy periodically. When we change this Privacy Policy in a material way, we will update the "last modified" date at the top of this Privacy Policy. Changes to this Privacy Policy are effective when they are posted on this page.
